- Scope of Application
The following General Terms and Conditions (GTC) apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a legally capable partnership who, when entering into a legal transaction, acts in the course of their commercial or self-employed professional activity.

Contractual Partner, Conclusion of Contract
The purchase contract is concluded with melu kids GmbH. The presentation of products in the online shop does not constitute a legally binding offer but is merely an informal online catalog. You can initially place our products in the shopping cart without obligation and correct your entries before submitting your binding order at any time using the correction aids provided and explained during the ordering process. By clicking the order button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of your order will be sent to you by email immediately after the order is submitted. The contract with us is concluded according to the payment method you have chosen:
Klarna Invoice
We accept your order by sending an acceptance declaration in a separate email or by delivering the goods within two days.
Credit Card
By placing the order, you simultaneously provide us with your credit card details. After your authentication as the rightful cardholder, we will request your credit card company to initiate the payment transaction, thereby accepting your offer.
PayPal, PayPal ExpressDuring the ordering process, you will be redirected to PayPal's website. To pay via PayPal, you must be registered or register, authenticate with your login credentials, and confirm the payment instruction to us. After placing the order in the shop, we will request PayPal to initiate the payment transaction. PayPal will process the transaction automatically. Further instructions will be provided during the ordering process.
Sofort by Klarna
After placing the order, you will be redirected to Sofort GmbH’s website. To pay via Sofort, you must have an online banking account activated for Sofort with PIN/TAN procedure, authenticate, and confirm the payment instruction. Sofort will process the transaction immediately and charge your account.
Amazon Pay
During the ordering process, you will be redirected to Amazon's website before completing the order in our online shop. To use Amazon for the order process and payment, you must be registered or register, authenticate with your credentials, select the delivery address and payment method, confirm the use of your data by Amazon, and the payment instruction to us. You will then be redirected back to our online shop to complete the order. After placing the order, we will request Amazon to initiate the payment transaction. Amazon will automatically process the transaction. Further instructions will be provided during the ordering process.

Contract Language, Storage of Contract Text
The language available for concluding the contract is German. We store the contract text and will send you the order details and our GTC by email. -
Delivery Conditions / Shipping
Deliveries are only possible to addresses within Germany, Austria, and Switzerland. Shipping within Germany is free of charge. Shipping to a Swiss address costs 1.99 EUR. Delivery is exclusively via shipping methods.
If a shipment needs to be re-sent due to an incorrect address provided by the buyer, we reserve the right to charge the shipping costs later. The fee is 1.00 EUR for Germany and 1.99 EUR for Switzerland. It is the buyer’s responsibility to verify all details before completing the order.

Our shop generally offers the following payment methods:
Credit Card
By placing the order, you provide us with your credit card details. Invoice Purchase via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer the invoice purchase as a payment option. Please note that Klarna invoice is only available for consumers and payments must be made to Klarna. With Klarna invoice, you always receive the goods first and have a payment term of 14 days. Retention of Title
The goods remain our property until full payment is received. -
Transportation Damage
If goods are delivered with obvious transportation damage, please immediately complain to the carrier and contact us without delay. Failure to make a complaint or contact us will not affect your statutory claims and their enforcement, particularly your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance. -
Warranty and Guarantees
The statutory warranty rights apply. For used goods: If a defect occurs after one year from delivery of the goods, warranty claims are excluded. Defects occurring within one year of delivery can be asserted within the statutory limitation period of two years from delivery.

Statutory Right of Withdrawal
Information about the statutory right of withdrawal can be found here. The statutory right of withdrawal is mandatory for both parties and applies primarily from the date of delivery for 14 working days.
10. Contractual Right of Return and Exchange
In addition to the statutory right of withdrawal for consumers and users as per clause 9 above, we grant you a contractual right of return and exchange. This right applies to all items purchased through the melu kids online shop. It applies to all products unless otherwise stated. For products purchased through other marketplaces than the melu kids online shop (www.melu-kids.de), the respective contractual terms of the respective provider apply.
10.1 Return of Entire Order
For orders with a total amount over 150.00 Euros placed more than 30 days ago and fully returned, we, melu kids GmbH, reserve the right to issue a voucher for the entire purchase amount instead of a refund. This voucher is valid for 3 years until the end of a calendar year from the date of issue. Exceptions may apply.
10.2 Exchange by Gift Recipient
An exchange by the gift recipient, hereinafter the second owner, is only possible if they have and provide the complete details of the giver, hereinafter the first owner or buyer (name, address, email address, and order number).

Undeliverable Delivery
If your order cannot be delivered after several attempts for reasons not attributable to us, it will be returned to us. In this case, we assume that you wish to withdraw from the contract, which then automatically converts into a restitution claim. Consequently, we will refund all payments received from you, excluding shipping costs, no later than 14 days after withdrawal (excluding additional costs arising from choosing a delivery method other than the standard delivery offered by us).
- Discounts & Discount Codes
11.1 Use of Discounts & Discount Codes
Each discount code can be used only once per purchase and per customer. Only one discount code can be used per order. Combining different discount codes is not possible. Combining bundles and discount codes is also not allowed.
If a discount code is applied to an already reduced price (larger packaging unit/bundle), the discount will be deducted from the individual price. Cash redemption of discount codes is not possible, nor is any other form of settlement or refund of the monetary value of a discount code. Discount codes issued to customers are not for resale, and assignment is not permitted. Discount codes are valid only for the melu kids online shop (https://melu-kids.de).
Validity:
Discount codes are valid for a limited time. They expire after the date mentioned on the discount code. Extensions are not possible.
Minimum Order Value:
A minimum order value is always stated in the details of the respective discount code. If the minimum order value is not met due to the return of the corresponding item, melu kids reserves the right to charge the difference between the order with the discount code and the order without the discount code.
Return of Items:
If you exercise your right of withdrawal or if there is a return of goods for other reasons, only the reduced purchase price will be refunded. There is no entitlement to a refund of the discount code or to a new discount code.
Allocation for Multiple Items:
If an order containing a discount code consists of several items (shopping cart discount), melu kids reserves the right to allocate the reduced amount to one or several items proportionally.
Non-fulfillment of an Order or Delivery:
In case of non-fulfillment of the order or individual items covered by the discount code, there is no entitlement to a refund of the discount code value or a new discount code.
Discount Codes from Third-Party Providers:
Redemption of discount codes, vouchers, or other bonus systems from third-party providers, such as Miles&More, Paypal, PayBack, Otto.de, or Amazon, is not valid. We are not responsible for the accuracy of offers or discount codes on third-party websites.
- Liability
The above limitations and time reductions do not apply to claims arising from damages caused by us, our legal representatives, or vicarious agents. We are always fully liable:
- for injury to life, body, or health,
- for intentional or grossly negligent breaches of duty,
- for guarantee promises, if agreed upon, or
- as far as the scope of the Product Liability Act is concerned.
In the event of a breach of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contract partner regularly relies (cardinal obligations) due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited to the damage foreseeable at the time of contract conclusion, with the occurrence of which one typically expects. Otherwise, claims for damages are excluded.

Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here: ODR Platform. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
