1. Scope

These terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor professional. An entrepreneur is a natural or legal person or a legally capable partnership acting in the course of their commercial or independent professional activity.

2. Contracting Party, Contract Conclusion

The purchase contract is concluded with melu kids GmbH. The presentation of products in the online shop does not constitute a legally binding offer, but rather an informal online catalog. You can initially place our products in the shopping cart without obligation and correct your entries before submitting your binding order using the correction tools provided during the ordering process. By clicking the order button, you place a binding order for the items in your cart. Confirmation of receipt of your order will be sent by email immediately after you submit your order. 

The contract with us is concluded based on the payment method you choose:

  • Klarna Invoice: We accept your order by sending an acceptance declaration in a separate email or by dispatching the goods within two days.

  • Credit Card: By placing the order, you provide us with your credit card details. After verifying your legitimacy as the rightful cardholder, we will request your credit card company to initiate the payment transaction, thus accepting your offer.

  • PayPal, PayPal Express: During the order process, you will be redirected to PayPal's website. There, you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we will instruct PayPal to initiate the payment transaction, thereby accepting your offer.

  • Sofort by Klarna: After placing the order, you will be redirected to Sofort GmbH's website to confirm the payment instruction. The contract with us is concluded upon this confirmation.

  • Amazon Pay: During the order process, you will be redirected to Amazon's website to select your stored delivery address and payment method, and confirm the payment instruction to Amazon. You will then return to our online shop to complete the order. After placing the order, we will request Amazon to initiate the payment transaction, thus accepting your offer.

3. Contract language, contract text storage

The language available for contract conclusion is German. We store the contract text and send you the order details and our terms and conditions by email.

4. Delivery conditions / shipping

Deliveries are only possible to addresses within Germany, Austria, Luxembourg, and Switzerland. Shipping within Germany is free of charge. Delivery is made exclusively via the shipping route. In the case of a redelivery due to an incorrectly provided address by the buyer, we reserve the right to charge the shipping costs subsequently. It is the buyer’s responsibility to verify all details before completing the order process.

5. Payment

Our shop generally offers the following payment methods:

  • Credit Card: By placing the order, you provide us with your credit card details. After verifying your legitimacy as the rightful cardholder, we will request your credit card company to initiate the payment transaction. The payment transaction will be automatically processed by the credit card company, and your card will be charged.
  • PayPal, PayPal Express: During the order process, you will be redirected to PayPal's website. To pay via PayPal, you must be registered there or register, authenticate with your login details, and confirm the payment instruction. After placing the order, we will instruct PayPal to initiate the payment transaction, which will be automatically processed by PayPal.
  • Sofort by Klarna: After placing the order, you will be redirected to Sofort GmbH’s website. To pay via Sofort, you need an online banking account with PIN/TAN procedure, authenticate, and confirm the payment instruction. The payment transaction will be carried out immediately by Sofort, and your account will be charged.
  • Amazon Pay: During the order process, you will be redirected to Amazon’s website to select your stored delivery address and payment method and confirm the payment instruction. You will then return to our online shop to complete the order. After placing the order, we will request Amazon to initiate the payment transaction, which will be automatically processed by Amazon.
  • Purchase on Invoice via Klarna: In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer invoice payment as an option. Please note that Klarna invoice is only available for consumers, and payment must be made to Klarna. With Klarna invoice, you always receive the goods first, and you have a payment period of 14 days. 6. Retention of title

The goods remain our property until full payment has been received.

7. Damage During Transport

If goods are delivered with obvious transport damage, please report such defects immediately to the carrier and contact us without delay. Failure to make a complaint or contact us does not affect your statutory rights and their enforcement, particularly your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance.

8. Warranty and Guarantees

The statutory warranty rights apply. For used goods, if a defect occurs after one year from delivery, warranty claims are excluded. Defects occurring within one year from delivery can be claimed within the statutory limitation period of two years from delivery.

9. Statutory right of withdrawal

Information about the statutory right of withdrawal is available here. The statutory right of withdrawal is mandatory for both parties and applies for 14 working days from the date of delivery.


  1. Contractual Return and Exchange Policy

In addition to the statutory right of withdrawal for consumers and users as per clause 9 above, we offer a contractual return and exchange policy. This applies to all items purchased through the melu kids online shop, unless otherwise stated. For products purchased through other marketplaces besides the melu kids online shop (www.melu-kids.de), the respective terms and conditions of the seller apply.

10.1 Return of Complete Orders: For orders over 150.00 euros placed more than 30 days ago and returned in full, melu kids GmbH reserves the right to issue a voucher instead of a refund. This voucher is valid for 3 years from the end of the calendar year in which it was issued. Exceptions may apply.

Claims for Gifts: Exchanges by the recipient of a gift (second owner) are only possible if they provide the complete details of the giver (first owner or buyer), including name, address, email address, and order number.

11. Undeliverable Deliveries

If your order cannot be delivered after several attempts due to reasons not attributable to us, it will be returned to us. In this case, we assume that you wish to withdraw from the contract, which will then automatically convert into a restitution obligation. As a consequence, we will promptly refund all payments received from you, excluding shipping costs, within 14 days of withdrawal (excluding additional costs resulting from choosing a different shipping method than the standard shipping offered by us).

12. Discounts & Promo Codes
12.1 Use of Discounts & Promo Codes

Each promo code can only be used once per purchase and per customer. Only one promo code can be used per order. Combining different promo codes is not possible. Bundles and promo codes cannot be combined.

If a promo code is applied to a discounted offer price (larger packaging unit/bundle), the discount will be applied to the individual price. Promo codes cannot be redeemed for cash or any other form of reimbursement. Promo codes issued to customers are not for resale, and transfer is not permitted. Promo codes are valid exclusively for the melu kids online shop (https://melu-kids.de).

Validity: Promo codes are valid for a limited time. They expire on the date specified on the promo code. Extensions are not possible.

Minimum order value: A minimum order value is always stated in the details of the respective promo code. If the minimum order value is not met due to a return of the corresponding item, melu kids reserves the right to charge the difference between the order with the promo code and the order without the promo code.

Return of Items: If you exercise your right of withdrawal or if the goods are returned for other reasons, only the reduced purchase price will be refunded. There is no entitlement to a refund of the promo code or a new promo code.

Allocation for Multiple Items: If an order containing multiple items (cart discount) is subject to a promo code, melu kids reserves the right to allocate the discount amount to one or several items proportionally.

Non-fulfillment of Orders or Deliveries: If the order or individual items to which the promo code applied are not fulfilled, there is no entitlement to a refund of the promo code value or a new promo code.

Promo Codes from Third-Party Providers: Redemption of promo codes, vouchers, or other bonus systems from third-party providers, such as Miles&More, PayPal, PayBack, Otto.de, or Amazon, is not valid. We are not responsible for the accuracy of offers or promo codes on third-party sites.

13. Liability

The aforementioned limitations and reductions in liability do not apply to claims for damages caused by us, our legal representatives, or agents. We are always fully liable:

  • For injury to life, body, or health,
  • For willful or grossly negligent breaches of duty,
  • For guarantees, if agreed, or
  • To the extent the scope of the Product Liability Act is

In the event of a breach of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contractual partner reasonably relies (cardinal duties), and such breaches are due to slight negligence by us, our legal representatives, or agents, liability is limited to foreseeable damages that typically arise from the contract. Any further claims for damages are excluded.
